The Military-Civil Relationship: Conflict or Co-Operation?

AFLANZ and the New Zealand Defence Force Directorate of Legal Services held a successful conference on 9 and 10 February 2007, at Trentham Military Camp at Upper Hutt.  About 35 people attended, including Regular Force legal staff from NZDF, Judge Advocates, members of the Courts Martial panel, and a number of distinguished guests from Norway, the United Kingdom and Australia.

 The proposed changes to the Armed Forces Discipline Act were presented by Commander Chris Griggs, and work shopped by three panels.  A number of practical changes were suggested, which may make their way into the Bill when it is finalised.

Significant proposed changes include:

  • a single summary disposal process for all three services.
  • a permanent Court Martial of New Zealand, rather than ad-hoc Courts Martial,  allowing pre trial issues to be resolved.
  • new appeal provisions.

These are the most substantial amendments to the AFDA since its introduction over 30 years ago.
